Terms of Use for Candlytics

Agreement to Terms

By downloading, accessing, or using Candlytics (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use Candlytics.

Candlytics is operated by RIPPPL LLC, doing business as Hibba Ventures (“we,” “us,” or “our”).

Eligibility

To use Candlytics, you must:

• Be at least 18 years old
• Have the legal capacity to enter into these Terms
• Provide accurate information when creating an account or profile
• Comply with all applicable laws, including securities, commodities, and tax laws in your jurisdiction

NOT FINANCIAL ADVICE

Candlytics is an educational and analytical tool only. Nothing in the App, on our website, or in any AI-generated output constitutes financial, investment, trading, tax, accounting, or legal advice.

Candlytics does not:

• Recommend that you buy, sell, hold, short, or take any other position in any security, commodity, derivative, cryptocurrency, currency, or other financial instrument
• Provide personalized advice based on your financial situation, risk tolerance, time horizon, or goals
• Act as a broker-dealer, investment adviser, futures commission merchant, commodity trading advisor, money services business, or any other registered financial entity
• Place orders, hold custody of your assets, or connect to any brokerage account, exchange account, or wallet
• Guarantee the accuracy, completeness, or profitability of any analysis, pattern recognition, or commentary it produces

AI-generated analyses are generated by a third-party large language model based on the image you submit. They are probabilistic, can be wrong, and should be treated as one input alongside your own research. Always conduct your own due diligence and consider consulting a licensed financial advisor before making any trading or investment decision.

Risk Disclosure

Trading and investing involve substantial risk of loss and are not suitable for every investor. By using Candlytics you acknowledge and accept the following risks:

• You may lose some or all of your invested capital, and you should never trade with money you cannot afford to lose
• Past chart patterns, indicators, and price action do not reliably predict future results
• Volatility in any market — especially cryptocurrencies and leveraged products like options, futures, and margin — can cause rapid and significant losses
• Options and futures can result in losses greater than your initial investment due to leverage
• Cryptocurrency markets are largely unregulated, operate 24/7, and may suffer from low liquidity, exchange failures, fraud, and abrupt regulatory changes
• Forex markets carry currency, interest-rate, and country risk and are typically traded with significant leverage
• Tax treatment of trading gains and losses varies by jurisdiction and product — you are solely responsible for understanding and complying with applicable tax law

You are solely responsible for every trading decision you make, whether or not it is informed by any output from Candlytics.

What Candlytics Does

Candlytics is a screenshot-based chart analysis app that uses artificial intelligence to identify visible candlestick patterns, summarize price-action structure, and produce plain-language commentary based on the chart image you submit. Candlytics offers:

• Image-based candlestick and chart-pattern recognition
• Trend and structure commentary across multiple timeframes
• Saved analyses with notes and personal annotations
• Cross-device sync of your saved analyses

What Candlytics Is NOT

Candlytics is not a broker, exchange, advisor, signal service, or guaranteed winning system. Candlytics does not:

• Execute trades
• Custody assets
• Provide real-time market data or order routing
• Provide personalized investment advice or model portfolios
• Promise any specific outcome, win rate, return, or performance
• Replace the judgment of a qualified human professional

Subscriptions and Payments

Candlytics offers subscription plans through the Apple App Store. By subscribing you agree to the following:

• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period
• Your iTunes account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal at iOS Settings → [your name] → Subscriptions
• Refund requests are handled by Apple at reportaproblem.apple.com
• Prices are shown in the App and may change with notice

Acceptable Use

You agree NOT to:

• Use Candlytics for any unlawful purpose or in any way that violates applicable law
• Misrepresent Candlytics output as your own original research when redistributing it to clients or subscribers in a regulated capacity (for example, by a registered investment adviser, broker-dealer, or licensed professional) without proper disclosure
• Upload chart screenshots containing personally identifying information of other people, confidential information you are not authorized to share, or content that infringes intellectual property rights
• Reverse engineer, decompile, scrape, or otherwise attempt to extract the underlying models, prompts, or system instructions
• Use Candlytics output as the sole basis for managing assets on behalf of any third party
• Resell, sublicense, or commercially exploit access to the App without our written permission
• Use the App to attempt market manipulation, insider trading, or any other prohibited trading practice
• Bypass, disable, or interfere with security or rate-limiting features of the App

Your Content

You retain ownership of the chart screenshots and notes you upload. By using Candlytics, you grant us a limited license to store, process, and transmit your content as needed to operate the App (including sending screenshots to Anthropic for analysis and storing them in your private Supabase folder for sync).

You represent that you have the right to upload any content you submit and that your submissions do not infringe on the rights of any third party.

Intellectual Property

Candlytics, including its software, design, branding, and AI-generated commentary as delivered through the App, is owned by RIPPPL LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms.

Third-Party Services

Candlytics relies on third-party services including Anthropic (Claude API), Supabase, Apple, Superwall, and Mixpanel. Your use of features that depend on these providers is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party provider.

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of any analysis, pattern detection, signal, or commentary generated by the App. AI output can contain errors, hallucinations, or omissions. You agree not to rely on Candlytics output as the sole basis for any trading or investment decision.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RIPPPL LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, TRADING LOSSES, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE CANDLYTICS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless RIPPPL LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any trading or investment decision you make; or (e) any content you upload.

Account Termination

You may delete your account at any time from Settings → Delete account. We may suspend or terminate your access to the App if you violate these Terms, abuse the service, or use it in a way that creates risk for us or other users. Termination does not entitle you to a refund except as required by applicable law or Apple’s policies.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last Updated” date. Your continued use of Candlytics after the update constitutes acceptance of the revised Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your statutory rights as a consumer in your jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
